Appeal to Probability

What it is

Treating something as certain, or as having happened, because it is possible or has some probability — “it could happen, so it will,” or “it could have happened, so it did.”

How it works

The form collapses the distinction between possible, probable, and actual. Its mechanism is probability neglect: Sunstein (2002) showed that when an outcome is vivid and emotionally charged, people respond to its mere possibility and become insensitive to how likely it is, and Rottenstreich and Hsee (2001) found that affect-rich outcomes flatten the weighting of probabilities so that a one-percent chance and a ninety-nine-percent chance of an electric shock are valued almost alike. The fallacy is the argumentative use of that flattening. It has a modal form (possibility asserted as necessity) and an evidential form (opportunity asserted as occurrence): “the machines could be hacked, so they were,” “the data could be misused, so it will be,” “someone has to win the lottery, so it might as well be me.” Murphy's law is its folk statement. The honest version is a fearful or hopeful mind reasoning from imaginable scenarios. The knowing version sells or accuses with it: security and insurance marketing that names the possible catastrophe and never the rate, conspiracy accusations built on opportunity, precautionary arguments that treat any nonzero risk as decisive. The tell is a claim about what did or will happen defended only by the observation that it could.

Real-world examples

  • After the 2004 U.S. election, activists on the left argued that electronic voting machines in Ohio could have been manipulated and treated the possibility as evidence that they were; after 2020, activists on the right made the same argument about a different vendor. In both cases investigations found no evidence that the possibility had been realized.
  • Home-security and identity-theft advertising describes the break-in or the stolen identity in detail and omits the base rate; the vividness of the possible loss does the selling.
  • “Someone has to win” lottery reasoning treats the certainty that some ticket wins as if it raised the chance that this ticket does.
  • Precautionary arguments sometimes hold that because a technology could cause harm it must be banned, without weighing the probability against the harms of the alternative; the argument is deployed against nuclear power more often on the left and against vaccines more often on the right, and is invalid in both.
  • A manager refuses to approve a plan because “something could go wrong,” which is true of every plan and therefore not a reason against this one.

Ethical guidelines

  • When you raise a possibility, attach a probability, however rough, and say what it is based on.
  • Do not argue from opportunity to occurrence; that a thing could have happened is the beginning of an investigation, not its conclusion.
  • In marketing and advocacy, present the rate alongside the scenario; a vivid possible harm with no frequency is a manipulation of probability neglect.
  • Apply the precautionary principle symmetrically: the alternative to the risky option also has risks, and they must be weighed at their probabilities.

How to defend against it

  • Ask “how likely?” and insist on a number or a range, not an adjective; if none can be given, the possibility is not yet an argument.
  • Ask “did it?” — separate the modal claim (could) from the factual claim (did) and ask for evidence specific to the second.
  • Convert to natural frequencies (Gigerenzer 2002): “out of a thousand people in my situation, how many does this happen to?” restores the sensitivity to probability that vividness removes.
  • Name the symmetry: everything possible could go wrong; ask what makes this possibility worth acting on rather than all the others.
  • When fear or hope is doing the work, apply the 24-hour rule before deciding; probability neglect is strongest in the moment the scenario is described.
